END-USER LICENSE AGREEMENT (EULA)

Permission to Distribute the Parental Involvement Pledgetm. & the Parental Involvement Report Cardtm


IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is an agreement between you (either an individual or a single entity) and the National Campaign for Public School Improvement, a not-for-profit corporation, for the distribution of the Parental Involvement Pledge and/or the Parental Involvement Report Card. By downloading, transferring, printing, copying, or otherwise using the Parental Involvement Pledge or Parental Involvement Report Card, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use the Parental Involvement Pledge or Parental Involvement Report Card, it is unlawful!

LICENSE. The Parental Involvement Pledge and the Parental Involvement Report Card are protected by copyright and trademark laws and international copyright treaties, as well as other intellectual property laws and treaties. The Parental Involvement Pledge or Parental Involvement Report Card is licensed, not sold.

1. GRANT OF LICENSE. You and/or your school are responsible for payment, and agree to submit payment or a school purchase order for payment, within 30 days of receipt of invoice. Upon payment of the required fees to the National Campaign for Public School Improvement, you may generate an unlimited number of copies for one academic year of the Parental Involvement Pledge and/or Parental Involvement Report Card in your schools and local community to organize parental involvement or to test its compatibility with other school and community programs. This EULA is renewable each year thereafter at the original EULA fees.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. Rental. You may not rent or lease the right to copy the Parental Involvement Pledge or Parental Involvement Report Card. Transfer. You may not transfer any of your rights under this EULA. Termination. This EULA shall terminate within one calendar year. Without prejudice to any other rights, Project Appleseed, the National Campaign for Public School Improvement may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Parental Involvement Pledge or Parental Involvement Report Card and all of its component parts.

National Volunteer Database Feedback. You agree to provide feedback to Project Appleseed, the National Campaign for Public School Improvement, including but not limited to all volunteer information that is gained from distribution of the Parental Involvement Pledge and/or Parental Involvement Report Card, including the name, address and phone number of each parent and citizen who takes the Parental Involvement Pledge and/or Parental Involvement Report Card. This national database allows Project Appleseed to directly send parents important information about how to become more involved in their local public schools. Project Appleseed Will Not and Does Not Sell This Information To Any Third Parties (ie..telemarketers!). Schools that object to the reporting of this information to Project Appleseed can decline this requirement.

3. COPYRIGHT. The Parental Involvement Pledge or Parental Involvement Report Card is protected by copyright and trademark laws and international treaty provisions. Therefore, you must treat The Parental Involvement Pledge or Parental Involvement Report Card like any other copyrighted and trademarked material.

MISCELLANEOUS. If you acquired the Parental Involvement Pledge or Parental Involvement Report Card in the United States, this EULA is governed by the laws of the State of Missouri. If this license was acquired outside the United States, then local law may apply.
